You should now reply in writing within 14 days.

You can choose to consent or dissent:

Consent

You can consent to the work and allow your neighbour to start without a Party Wall Agreement. 

Under the Act, you have the right to appoint a Party Wall Surveyor later in the process.

You may choose to have a schedule of condition carried out, to record the existing condition of your property before the work begins. This will be paid for by your neighbour.

Dissent

If you choose not to consent to the works then a surveyor must be appointed. You can appoint a surveyor together, or each appoint your own.

The surveyor/s will examine the existing condition of your property and produce a Schedule of Condition, recording the current condition of the wall.

The surveyor/s will then produce a document called a Party Wall Award, which will list the work to be done and how it should be carried out. The Award will balance the interests of both parties.

Where two surveyors are used, they will appoint an experienced Third Surveyor, who will be called upon in the event that the two surveyors do not agree.

Payment for the surveyor/s will be made by your neighbour.
